1) Scope of Application

1.1 These Terms and Conditions (“GTC”) of BG Investment GmbH (referred to as the “Seller”) govern all contracts entered into between a buyer (“Client”) and the Seller concerning goods and services available in the Seller’s online shop. The inclusion of the Client’s terms is expressly rejected unless explicitly agreed otherwise.

These Terms and Conditions also apply to users of the Seller’s website.

1.2 By using the Seller’s website, the Client acknowledges and agrees to be bound by these GTC.

1.3 The Seller reserves the right to modify or replace these GTC at any time. Clients will be notified of significant changes at least 30 days in advance. Continued use of the Seller’s services after the changes take effect constitutes agreement to the updated terms.

1.4 The Client consents to electronically reviewing, signing, and authenticating documents per the Electronic Signatures in Global and National Commerce Act (“E-SIGN Act”), the Uniform Electronic Transactions Act (“UETA”), and applicable state laws. The Client’s electronic signature holds the same legal weight as a handwritten signature. Documents may be stored solely in electronic format and classified as “transferable records” under UETA.


2) Conclusion of the Contract

2.1 Product descriptions on the Seller’s website do not constitute binding offers but serve as invitations for the Client to submit a contractual offer.

2.2 The Client submits an offer by completing the online ordering process and confirming the order. This action creates a legally binding offer for the selected goods or services.

2.3 The Seller may accept the Client’s offer within five days by:

  • Sending a written order confirmation (via fax or email), with receipt by the Client being decisive.

  • Dispatching the ordered goods to the Client, with receipt of goods being decisive.

  • Requesting payment from the Client after order placement.

If none of the above occurs within the specified period, the Client’s offer is deemed rejected, releasing them from any obligation.

2.4 The acceptance period begins the day after the Client submits the offer and expires at the end of the fifth day.

2.5 The Seller stores the contract details and sends them to the Client, including these Terms and Conditions, after order submission. The contract details will not be accessible on the Seller’s website after the order is completed.

2.6 Before submitting the order, the Client can review and modify entered data using standard keyboard and mouse functions. A confirmation screen provides an additional opportunity for corrections.

2.7 The contract language is exclusively English.


3) Return Policy

Clients have 30 days from receiving their order to request a return.

To initiate a return, contact us at support@firestorehomes.com.

If the return is approved, we will provide a return shipping label and instructions. Items sent without prior approval will not be accepted.

Returns are not accepted for sale items or gift cards.

To be eligible for a return, items must be unworn, unused, in original packaging, and accompanied by proof of purchase.

Damaged or incorrect items should be reported immediately upon receipt for resolution.

Refunds are processed within 10 business days of approval, with potential delays due to banking procedures. If 15 business days pass without a refund, contact us at support@firestorehomes.com.


4) Price and Delivery Costs

4.1 Prices are listed in USD, excluding taxes and shipping fees, which are detailed separately in product descriptions. If an item is mistakenly priced lower than listed, the Client will be charged the lower amount. If priced higher, the Seller will either confirm the updated price with the Client or cancel the order.

4.2 Additional charges (e.g., bank transfer fees, taxes, customs duties) may apply for US deliveries and must be borne by the Client.

4.3 Payment methods available are those displayed in the Seller’s online shop.


5) Shipment and Delivery Conditions

5.1 Orders are shipped to the delivery address provided by the Client unless stated otherwise.

5.2 If an item is unavailable, the Seller will notify the Client via email and offer a substitution or cancellation. If canceled, a refund will be issued for debited amounts. The Seller is not liable for product unavailability.

5.3 If delivery is unsuccessful due to the Client, the transport company will return the package to the Seller, and the Client will bear the return shipping costs.


6) Warranty

The Seller disclaims all implied warranties, including fitness for a particular purpose. Liability for indirect, special, or consequential damages is excluded. The Seller’s total liability shall not exceed the purchase price paid for the specific goods in dispute.

Some jurisdictions do not permit the exclusion of implied warranties; in such cases, exclusions are limited to the extent required by law.


7) Limitation of Liability Regarding the Use of the Seller’s Online Shop

7.1 The Seller’s online shop is provided “AS IS” without warranties. The Seller makes no guarantees regarding the completeness, accuracy, or reliability of website content, nor uninterrupted or error-free access.

7.2 The Seller is not responsible for damages caused by viruses from downloading material from the website.

7.3 External links on the Seller’s website are provided in good faith, but the Seller is not responsible for their content or privacy policies.

7.4 Some jurisdictions may limit these disclaimers; they apply only as far as legally permitted.


8) Limitation of Action

Claims related to this contract must be filed within 12 months from the date the cause of action was discovered.


9) Governing Law

All legal relationships between the Client and Seller are governed by the laws of the Federal State of Illinois, excluding the UN Convention on Contracts for the International Sale of Goods.


10) Designation of Forum

Legal actions related to this contract must be filed in the courts of the state where the Seller is based. Both parties consent to this exclusive jurisdiction.
